Terms and Conditions of Sale

Cible Skin Laboratory specializes in skin health treatments. Its main activity is the research, manufacturing, and distribution of cosmetic products.

As part of its activities, Cible Skin Laboratory publishes the website accessible at www.cibleskin.com, which presents and sells its cosmetic treatments and care services.

ARTICLE 1 - SCOPE OF APPLICATION

These General Terms and Conditions of Sale (referred to as "GTC") apply, without restriction or reservation, to all sales concluded by Cible Skin Laboratory (the "Seller") with non-professional buyers ("Clients" or "Client"), wishing to acquire the products offered for sale ("Products") by the Seller on the website www.cibleskin.com.

The Products offered for sale on the website are as follows:

• "IMMUNO-COSMETICS" Cosmetics
• "IMMUNO-EXPERIENCES" Care Services.

The main characteristics of the Products, including specifications, illustrations, and indications of dimensions or capacity of the Products, are presented on the website www.cibleskin.com, which the client is required to review before ordering.

The choice and purchase of a Product are the sole responsibility of the Client.

Product offers are subject to available stock, as specified when placing the order.

These GTC are accessible at any time on the website www.cibleskin.com and shall prevail over any other document.

The Client declares to have read these GTC and accepted them by checking the box provided for this purpose before initiating the online ordering procedure on the cibleskin.com website.

The Seller reserves the right to modify these GTC at any time. Only the GTC in force at the time of the order are applicable.

The invalidity of a clause in the GTC does not in any way lead to the invalidity of the GTC.

Unless proven otherwise, the data recorded in the Seller's computer system constitutes proof of all transactions concluded with the Client.

In case of an order to a country other than mainland France, the Client is the importer of the Product(s) concerned. For all Products shipped outside the European Union and DOM-TOM, the price will be calculated exclusive of tax automatically on the invoice. Customs duties or other local taxes or import duties or state taxes may be payable. They shall be borne by and are the sole responsibility of the Client.

ARTICLE 2 – PRODUCTS

The Products offered for sale by the Seller are described in accordance with article L.111-1 of the French Consumer Code.

In case of unavailability of the ordered Product in stock, Laboratoire Cible Skin undertakes to offer an equivalent replacement product of similar quality or, failing that, a voucher corresponding to the amount spent.

Product sales are reserved for individuals for their personal use and consumption and for authorized distributors.

ARTICLE 3 – PRICE

Products are supplied at the current prices listed on cibleskin.com, at the time the order is registered by the Seller.

Prices are expressed in Euros, all taxes included (TTC), with a VAT rate of 20%.

Prices take into account any reductions granted by the Seller on the cibleskin.com website. These prices are firm and non-revisable during their validity period, but the Seller reserves the right, outside the validity period, to modify prices at any time.

Prices do not include processing, shipping, transport, and delivery fees, which are charged additionally, under the conditions indicated on the website and calculated prior to placing the order.

The payment requested from the Client corresponds to the total amount of the purchase, including these fees.

An invoice is issued by the Seller and given to the Client upon delivery of the ordered Products.

ARTICLE 4 – ORDERS

It is up to the Client to select the Products they wish to order on the cibleskin.com website, following these steps:

The Client visits the website, browses the product catalog, and adds the selected items to their cart to proceed with the purchase. They then decide to continue as a guest without creating an account, or they can choose to create an account or log in if they already have an account on cibleskin.com. Once this step is completed, they must verify the order information before proceeding with its final confirmation and payment for the selected products.

Product offers are valid as long as they are visible on the website, within the limits of available stock. The sale will only be considered valid after full payment of the price. It is the Client's responsibility to verify the accuracy of the order and immediately report any error.

Any order placed on the cibleskin.com website constitutes the formation of a distance contract between the Client and the Seller.

The Seller reserves the right to cancel or refuse any order from a Client with whom there is a dispute regarding the payment of a previous order.

The Client can track the progress of their order on the website.

Any cancellation of the order by the Client will only be possible before the delivery of the Products, regardless of the provisions relating to the application or non-application of the legal right of withdrawal.

ARTICLE 5 - PAYMENT TERMS

Payment is made through a secure payment method, according to the following terms:

• payment by credit card

The price is payable in cash by the Client, in full on the day the order is placed.

Payment data is exchanged in encrypted mode thanks to the protocol defined by the approved payment provider involved in banking transactions carried out on the cibleskin.com website.

Payments made by the Client will only be considered final after effective collection by the Seller of the amounts due.

The Seller will not be obliged to deliver the Products ordered by the Client if the Client does not pay the price in full under the conditions indicated above.

ARTICLE 6 – DELIVERIES

The Products ordered by the Client will be delivered in France and internationally.

Delivery times vary depending on the service provider used for this mission and the address indicated by the Client when placing their order on the website.

Delivery consists of the transfer of physical possession or control of the Product to the Client. Except in specific cases or the unavailability of one or more Products, the ordered Products will be delivered in a single shipment.

The Seller undertakes to make its best efforts to deliver the products ordered by the Client within the deadlines specified above. If the ordered Products have not been delivered within 31 days after the indicative delivery date, for any reason other than force majeure or the Client's fault, the sale may be canceled at the written request of the Client under the conditions provided for in articles L 216-2, L 216-3, and L241-4 of the Consumer Code. The sums paid by the Client will then be refunded no later than fourteen (14) days following the date of cancellation of the contract, excluding any compensation or deduction.

Deliveries are carried out by an independent carrier, to the address mentioned by the Client when ordering and to which the carrier can easily access.

When the Client has himself arranged for a carrier of his choice, delivery is deemed to have been made upon delivery of the ordered Products by the Seller to the carrier who accepted them without reservation. The Client therefore acknowledges that it is the carrier's responsibility to carry out the delivery and has no recourse in warranty against the Seller in case of non-delivery of the transported goods.

The Seller also offers in-store pickup at the following address: 31, rue François 1er - 75008 Paris.

In the event of a specific request from the Client concerning the packaging or transport conditions of the ordered products, duly accepted in writing by the Seller, the associated costs will be subject to a specific additional invoice, based on a quote previously accepted in writing by the Client.

The Client is required to check the condition of the delivered products. They have a period of fourteen (14) days from delivery to submit complaints by phone, email, or mail, accompanied by all relevant supporting documents (especially photos). After this period and if these formalities are not complied with, the Products will be deemed compliant and free of any apparent defect, and no complaint can be validly accepted by the Seller.

The Seller will refund or replace as soon as possible and at its expense, the delivered Products whose non-conformities or apparent or hidden defects have been duly proven by the Client, under the conditions provided for in articles L 217-4 et seq. of the Consumer Code and those provided in these GTC.

The transfer of risks of loss and deterioration will only occur when the Client takes physical possession of the Products. The Products therefore travel at the Seller's risk, unless the Client has chosen the carrier themselves. In this respect, the risks are transferred at the time the goods are handed over to the carrier.

ARTICLE 7 - TRANSFER OF OWNERSHIP

The transfer of ownership of the Products from the Seller to the Client will only be realized after full payment of the price by the latter, regardless of the delivery date of the said Products.

ARTICLE 8 - RIGHT OF WITHDRAWAL

In accordance with the provisions of the Consumer Code, the Client has a period of fourteen (14) days to exercise their right of withdrawal from a distance contract concluded with Laboratoire Cible Skin.

This right of withdrawal begins to run from the date of delivery by the Client for Cosmetic Products and from the online order validation for Care Services.

Thus, after this period, the Client will no longer be able to exercise their right of withdrawal for cosmetic products and online booked Care Services.

When the Client has expressed their wish to withdraw during the fourteen (14) day period, they then have a new period of fourteen (14) days, from the notification of their wish to withdraw, to return the product in impeccable condition. After this period, the Client will no longer be able to exercise their right of withdrawal.

In the case of a Care Service booked online for a date that would arrive before the fourteen (14) day period, the Client accepts, by proceeding with their order, to waive the application of their right of withdrawal.

For care services booked online, it will only be possible to cancel the reservation if the request is made at least 48 hours before the initially scheduled appointment date.

The right of withdrawal can be exercised by sending an email to contact@cibleparis.com, expressing the wish to withdraw.

Products must be returned in their original, complete condition (packaging, accessories, instructions, etc.) allowing them to be remarketed as new, accompanied by the purchase invoice. Damaged, soiled, or incomplete Products will not be accepted for return. For hygiene reasons, a specific inspection will be applied to returns.

Delivery costs remain the responsibility of the Client, as well as additional costs such as taxes or customs duties for clearing returned products.

Laboratoire Cible Skin will not be responsible for losses, damages, and/or delays related to returns made from a country outside the Delivery Zone.

Exchange (subject to availability) or refund will be made within fourteen (14) days from the receipt, by Laboratoire Cible Skin, of the Products returned by the Client.

Please note: Gift cards are valid for one year.

ARTICLE 9 - SELLER'S LIABILITY – WARRANTIES

The Products supplied by Laboratoire Cible Skin benefit from:

• The legal guarantee of conformity, for defective, damaged or spoiled Products or those not corresponding to the order;
• The legal guarantee against hidden defects resulting from a material, design or manufacturing defect affecting the delivered products and rendering them unfit for use.

Provisions relating to legal guarantees

Article L217-4 of the Consumer Code:

"The seller is required to deliver goods that conform to the contract and is liable for any conformity defects existing at the time of delivery. He is also liable for conformity defects resulting from the packaging, assembly instructions or installation when this was carried out under his responsibility or was included in the contract."

Article L217-5 of the Consumer Code:

"The good conforms to the contract:

1° If it is suitable for the use ordinarily expected of a similar good and, where applicable:
• if it corresponds to the description given by the seller and possesses the qualities that the seller presented to the buyer in the form of a sample or model;
• if it has the qualities that a buyer can legitimately expect given the public statements made by the seller, the producer or his representative, particularly in advertising or labeling;

2° Or if it has the characteristics defined by mutual agreement between the parties or is suitable for any special use sought by the buyer, brought to the seller's attention and which the latter has accepted."


Article L217-12 of the Consumer Code:

"The action resulting from a lack of conformity lapses after two years from the delivery of the goods."

Article 1641 of the Civil Code:

"The seller is bound by the warranty against hidden defects of the sold item that render it unfit for the use for which it was intended, or that so diminish this use that the buyer would not have acquired it, or would have given only a lesser price for it, had he known of them."

Article 1648, first paragraph, of the Civil Code:

"The action resulting from redhibitory defects must be brought by the purchaser within two years of the discovery of the defect."

Article L217-16 of the Consumer Code:

"When the buyer asks the seller, during the commercial warranty granted to him at the time of the acquisition or repair of a movable good, for a repair covered by the warranty, any period of immobilization of at least seven days is added to the remaining warranty period. This period runs from the buyer's request for intervention or the availability of the good for repair, if this availability is subsequent to the request for intervention."

In order to assert their rights, the Client must inform Laboratoire Cible Skin, in writing (email or mail), of the non-conformity of the Products or the existence of hidden defects as soon as they are discovered. Laboratoire Cible Skin will reimburse, replace, or have repaired the Products or parts under warranty deemed non-compliant or defective.

Shipping costs will be reimbursed based on the invoiced rate and return costs will be reimbursed upon presentation of supporting documents.

Refunds, replacements, or repairs of Products deemed non-compliant or defective will be made as soon as possible and at the latest within 31 days following Laboratoire Cible Skin's confirmation of the lack of conformity or hidden defect. This reimbursement may be made by bank transfer or check.

Laboratoire Cible Skin's liability cannot be engaged in the following cases:

• Non-compliance with the legislation of the country in which the products are delivered, which the Client is responsible for verifying;
• In case of misuse, professional use, negligence or lack of maintenance on the part of the Client, as well as in case of normal wear and tear of the Product, accident or force majeure;
• The photographs and graphics presented on the website are not contractual and cannot engage the responsibility of Laboratoire Cible Skin.

The Seller's warranty is, in any case, limited to the replacement or reimbursement of non-compliant or defective Products.

ARTICLE 10 - PERSONAL DATA

The Customer is informed that the collection of their personal data is necessary for Laboratoire Cible Skin to sell the Products and to transmit them to third parties for the purpose of delivering the Products. This personal data is collected solely for the execution of the sales contract.

Collection of personal data
The personal data collected on the cibleskin.com website is as follows:
• When the Customer orders Products: Last names, first names, postal address, phone number, and email address.
• For the payment of Products offered on the cibleskin.com website, the website records financial data related to the Customer/user's bank account or credit card.

Recipients of personal data
Personal data is reserved for the sole use of Laboratoire Cible Skin and its employees.

Data Controller
The data controller is Laboratoire Cible Skin, within the meaning of the French Data Protection Act and, as of May 25, 2018, Regulation 2016/679 on the protection of personal data.

Limitation of processing
Unless the Customer gives their express consent, their personal data is not used for advertising or marketing purposes.

Data retention period
Laboratoire Cible Skin will retain the data thus collected for a period of 5 years, covering the statute of limitations for applicable contractual civil liability.

Security and confidentiality
Laboratoire Cible Skin implements organizational, technical, software, and physical digital security measures to protect personal data against alteration, destruction, and unauthorized access. However, it should be noted that the Internet is not a completely secure environment, and Laboratoire Cible Skin cannot guarantee the security of the transmission or storage of information on the Internet.

Implementation of Customer and user rights
In accordance with the regulations applicable to personal data, Customers and users of the cibleskin.com website have the following rights:
• They can update or delete their data by contacting customer service at the following email address: hello@cibleskin.com.
• They can delete their account by writing to the email address hello@cibleskin.com.
• They can exercise their right of access to know the personal data concerning them by writing to the email address hello@cibleskin.com.
• If the personal data held by Laboratoire Cible Skin is inaccurate, they can request the update of the information by writing to the email address hello@cibleskin.com.
• They can request the deletion of their personal data, in accordance with applicable data protection laws, by writing to the email address hello@cibleskin.com.
• They can also request the portability of data held by Laboratoire Cible Skin to another provider.
• Finally, they can object to the processing of their data by Laboratoire Cible Skin.

These rights, as long as they do not conflict with the purpose of the processing, can be exercised by sending a request by mail or email to the Data Controller whose contact details are indicated above.

The Data Controller must provide a response within a maximum period of one month. In case of refusal to grant the Customer's request, the refusal must be justified.

The Customer is informed that in case of refusal, they can file a complaint with the CNIL (3, place de Fontenoy - 75007 PARIS) or refer the matter to a judicial authority.

The Customer may be invited to check a box indicating their agreement to receive informational and advertising emails from Laboratoire Cible Skin. They will always have the option to withdraw their consent at any time by contacting the Seller (contact details above) or by following the unsubscribe link.

ARTICLE 11 - INTELLECTUAL PROPERTY

The content of the cibleskin.com website is the property of Laboratoire Cible Skin and its partners and is protected by French and international intellectual property laws.

Any total or partial reproduction of this content is strictly prohibited and may constitute an act of counterfeiting.

ARTICLE 12 - APPLICABLE LAW – LANGUAGE

These General Terms and Conditions of Sale and the transactions arising therefrom are governed by and subject to French law.

These General Terms and Conditions of Sale are written in French. In the event that they are translated into one or more foreign languages, only the French text shall be deemed authentic in the event of a dispute.

ARTICLE 13 – DISPUTES

For any complaint, please contact customer service at the Seller's postal or email address indicated in ARTICLE 1 of these General Terms and Conditions of Sale.

The Customer is informed that they can resort to conventional mediation, with existing sectoral mediation bodies or any alternative dispute resolution method (conciliation, for example) in case of dispute.

All disputes arising from purchase and sale transactions concluded under these General Terms and Conditions of Sale that have not been amicably settled between Laboratoire Cible Skin or through mediation will be submitted to the competent courts under ordinary law.
